The Section 106 agreement is designed to ensure that the home remains available to qualifying purchasers who meet defined local connection, housing need and financial eligibility requirements. This means that prospective purchasers need to establish their eligibility before proceeding with a purchase.


Who may be eligible?
Initially, applicants need to demonstrate an appropriate Area Local Connection to Ruan Lanihorne.

This can include:
  • Residency or permanent employment of at least 16 hours per week for three years or more.
  • Former residency within the parish for five years or more.
  • A qualifying close family connection where a mother, father, sister, brother, son or daughter has lived within the parish for at least five years and there is independent evidence that support needs to be given or received.

The geographical eligibility area can widen during the marketing period.

After 28 days, applicants with a qualifying local connection to the adjoining parishes of St Michael Penkivel, Tregony, Veryan and Philleigh can be considered.

After 56 days, this can extend to applicants with a qualifying local connection to Cornwall.
Applicants must also be considered to be in housing need and otherwise unable to afford a suitable home on the open market.

In addition, applicants will need the required deposit and a recent Agreement in Principle from a mortgage lender prepared to lend on a Section 106 property. Independent financial advice is recommended. Cornwall Council holds nomination rights for the first 15 days of marketing, meaning expressions of interest received during this period are referred to the Council for consideration.
